Oracle has issued a force majeure notice tied to Project Jupiter, the Stargate data center campus it is building in New Mexico, according to Bloomberg, a step that would let the company withhold payments if the site misses its 2028 opening.
The filing does not mean Oracle wants out. It plans to remain the campus’s anchor tenant, and the notice only buys breathing room on the payment schedule should construction drag. According to Bloomberg, the recipient was a unit of Blue Owl Capital. Energy and commodity contracts treat this as boilerplate, giving a party room to pause its obligations when forces outside its control intervene.
Both sides pushed back on the read-through. Oracle describes Project Jupiter as on schedule and says it is fully committed to New Mexico. Blue Owl says the notice leaves the financial commitments to the multi-year project untouched. Oracle shares still fell about 5%.
Bloom Energy fuel cells burning gas are meant to power the 2.45-gigawatt campus, so a steady fuel supply sits at the heart of the construction timetable. Energy Transfer’s pipeline to the site has slipped close to half a year, with February 1, 2027 now the target, after permit applications were turned down by regulators more than once. A separate air-quality permit still needs a ruling by November 23.
Stargate, the AI buildout that Oracle, OpenAI and SoftBank unveiled alongside President Donald Trump, numbers Project Jupiter among its flagship sites, and the project has turned into a political battleground as the midterms approach.
